name address [email protected] 210-234-5678 home 210-345-6789 work 210-456-4567 cell and 5C1, Ltd., the Lessor, 400 Boerne Stage Field, Boerne, TX 78006. 830-981-2345 x10; [email protected] 1} TERMS: This agreement shall commence on September 1st, 2009 and shall continue in effect from quarter to quarter, being automatically renewed after each quarter thereafter UNLESS 30 DAYS ADVANCED WRITTEN NOTICE IS GIVEN BY EITHER PARTY that the agreement shall not be renewed. 2} RENT: Lessee shall pay as rent for the use of the described Hangar the monthly amount of $ xxx.xx payable quarterly in advance by cash or check, on the 1st of each quarter: JAN, APRIL, JULY & OCT; or by auto debit on credit card {preferred payment method is auto debit} Interim periods pro rated. Rents paid by auto debit on the AirBP Visa or Sterling Card shall receive a patron discount of $10 per month off hangar rent. 3}

4} CARE OF PREMISES: Lessor will maintain the structural components of the Hangar. Lessor will furnish and maintain the combination lock. Lessee shall be responsible and liable for any damage to the hangar caused by Lessee's use, including, but not limited to, bent or broken interior walls, damage to unsealed floors due to fuel oil spillage or other chemicals, whether approved for storage or not, doors damaged due to Lessee's improper or negligent operation. Both parties to this agreement have inspected and accepted the premises in their present condition. A combination lock is in place & set for use. [does not apply to bi-fold electric] 5} LIABILITIES: Lessor hereby expressly disclaims any and all liability for damage to the aircraft or anything stored in the Hangar, except for such damage caused by movement of the aircraft by Lessor's employees, except that if Lessee participates in any way or gives instructions/directions to Lessor's employee(s), then Lessor shall not be liable in any way for damage to the aircraft. Lessee shall be liable for any damage to Lessor's property and/or other stored aircraft arising from Lessee's negligence including but not limited to the carrying on of unauthorized activities in the Hangar or the storage of flammable or other hazardous materials except fuel in aircraft tanks. Lessee must carry his own contents insurance as an occupant of the leased premises. Damage to any contents as a result of weather, Acts of God, natural acts or any other occurrences are not the responsibility of lessor. 6} USE OF PREMISES: The Hangar hereby leased shall be used only for the storage of aircraft owned or operated by Lessee, or project aircraft including homebuilding. Only minor maintenance allowed by the Federal Aviation Regulations (FARs) may be performed by an owner/operator on the premises. No commercial aviation activities will be conducted on the premises without prior consent in writing by Lessor. Business materials, records, papers, boxes, etc. shall be placed on blocks or pallets above the grade of the level concrete to prevent moisture and other damage. Lessee is advised the units are not air-tight, moisture proofed rooms suitable for long term storage of paper, cardboard boxes, or similar materials. Lessee has determined the suitability of the premises for his purposes. If an individual leases a unit and fails to place an aircraft in it [uses it as a “Mini-Storage” unit] this lease will be immediately revoked and the premises vacated. Off airport mechanics are not allowed to operate in rental units. If a renter has a preference for maintenance off airport, the aircraft shall be taken to that site. “Pickup truck, station wagon” mechanics and the like are not allowed on the premises. The only exception being an aircraft owned by an appropriately rated mechanic performing maintenance on his owned aircraft. Painting of ANY kind is absolutely prohibited. Lessee is responsible for damage to other aircraft arising from Lessee’s negligent actions.

7} SUBLEASE or ASSIGNMENT: Neither subletting nor assignment of the premises is allowed without advance written consent from Lessor. 8} TERMINATION: This agreement may be terminated by either party upon 30 days advance written notice of non-renewal as provided hereinbefore. Lessor may terminate this agreement during the course of a monthly term upon the occurrence of any of the following which shall constitute a breach of this lease agreement by Lessee: Rent not paid by the 10th of any month. Lessee fails to comply with provisions of this lease. In the event of a breach, Lessor shall notify Lessee of termination in writing. Lessee shall have ten (10) days to remove his aircraft from the Hangar, after which Lessor is hereby specifically authorized to remove the aircraft, without further obligation to Lessee or liability for aircraft removed, and park said aircraft in the grass fields. 9} SECURITY: Lessee agrees to cooperate with lessor in the enforcement and implementation of airport security procedures. Security of the hangar shall be the responsibility of Lessee. Lessor shall not be liable for theft, vandalism, or pilferage to any items stored in the Hangar. 10} INDEMNIFICATION: Lessee agrees to indemnify, defend and hold harmless Lessor from and against any and all injury, loss, damage or liability, or any claims in respect of the foregoing, costs or expenses, including attorneys’ fees & court costs, arising from Lessee’s use and occupancy of the space or the airport, including strict liability and negligence whether sole or joint of the lessor {such as, but not limited to, loss of use or diminution of value}. It is expressly agreed and understood that under no circumstances shall either party be liable to the other for indirect, incidental, consequential, special or exemplary damages, whether in contract or tort.
