Ethanol Bill Passes House House Bill 471, sponsored by Rep. Jim Marshall (R-Beaver), has passed the Pennsylvania House of Representatives by a vote of 155-42. HB 471 would amend the Biofuel Development and In-State Production Incentive Act removing ethanol blending requirements. PFMA supports this legislation. HB 471 is now assigned to the Senate Environmental Resources and Energy Committee. PFMA thanks Rep. Marshall for sponsoring this bill and PFMA members for their grassroots support.

Non-Resident Pharmacy Bill House Bill 75, sponsored by Rep. Rob Kauffman (R-Franklin), passed unanimously from the Senate in September. HB 75 would amend the Pharmacy Act adding a new section requiring pharmacies located outside of Pennsylvania to register with the State Board of Pharmacy if they fill prescription orders for residents of the Commonwealth. In addition, the legislation requires pharmacies to have a valid driver’s license in their home state and provide a copy of their most recent inspection report. HB 75 passed the House unanimously in February. It is now on the governor’s desk awaiting his signature, which it is expected to receive in early October. Thank you to Rep. Kauffman for championing this bill and helping it achieve quick legislative passage.

Food Security Summit Examines Hunger & Nutrition Issues in the Commonwealth

Pennsylvania Food Merchants Association (PFMA) staff participated in the 2015 Food Security Summit on Tuesday, September 29 at the Farm Show building in Harrisburg. The summit brought together government, nonprofit groups and private industry together to discuss hunger and nutrition issues.

Still No Budget: A Rough Day for Governor Tom Wolf Much of the Governor’s rhetoric during the budget impasse has hinted that rank-and-file legislators would vote for his tax package if given the chance. House Republican leadership in October decided to test that theory by allowing House members an upor-down vote on the Governor’s tax package, which he pared down to include:

• A jump in Personal Income Tax from 3.07 percent to 3.49 percent.

The Governor’s tax package failed by a vote of 127 to 73. In addition to all Republicans voting in opposition, they were joined by nine Democrats. Now all parties return to the negotiating table, with the Governor’s tax package a non-starter, and the Governor in a compromised negotiating position.

• A severance tax for natural gas drillers. The governor said his plan would raise nearly $1.4 billion in new, recurring revenue for the current fiscal

It was highly unlikely that this tax package would pass due to legislator knowledge of their constituents’ disdain for tax increases, and the simple math that a large chunk of the majority Republican House would have to defy their leadership and side with the Governor. And certainly enough, it did not pass.


Governor Tom Wolf & Rep. Paul Costa Float Liquor Proposals Amid the budget negotiations, Governor Tom Wolf proposed leasing the entire state liquor system, including retail and wholesale operations to a private management firm. While the state would retain ownership, the firm would determine the number of store and pricing in addition to maintaining the state’s union employees. According to the administration, the plan would allow for the possibility of wine in grocery stores and restaurants and six-packs in convenience stores. Rep. Costa’s legislation would allow restaurants, small delis and hotels to sell wine to go and beer in additional quantities,while beer distributors would be able to sell six-packs, mixed cases and growlers for people looking to sample different styles of beer. Licensed grocery stores also would be permitted to sell bottles of wine in addition to beer. He also would call for expanding Sunday store hours for Fine Wine and Good Spirit Stores, creating a customer reward and discount program, and allowing for the shipment of wine directly to consumers. Costa said his legislation would create jobs while preserving family-sustaining jobs, provide additional ways for consumers to purchase wine and beer in areas under served by the Liquor Control Board and keep prices down. PFMA will review these plans as more detailed information becomes available. The association favors a more expansive liquor privatization plan than what was offered this summer by House and Senate Republicans, but we do hope this will open a dialogue for further discussion to provide consumer convenience. 2 Spectrum

Square One Markets Pilots New Dinner Kit to Help Time-Starved Customers Square One Markets convenience store in Bethlehem, Pennsylvania began testing a new dinner kit last month that allows time-starved customers to quickly prepare nutritious family meals in less than 30 minutes. The all-in-one kits provide healthy options to consumers and eliminate three significant downsides to many popular meal-delivery kits: cost, packaging waste and the need to plan a day or more in advance to order them. Square One Markets is selling The Six O’Clock Scramble Fresh & Fast Family Dinner Kits™, developed by The Six O’Clock Scramble, a company dedicated to sharing fresh and fast family dinner solutions. The dinner kits provide all-in-one meal ingredients and recipe cards that contain everything time-stressed families need to prepare a fast, fresh meal. They sell for around $20 and are designed to feed a family of four. At $5 per person, the dinner kits are less than half the price of meal-delivery services — and without the packaging waste and carbon footprint from shipping. The kits also will feature some locally grown and produced ingredients from the Bethlehem area. Square One Markets and The Six O’Clock Scramble worked with the Project on Nutrition & Wellness (PNW) and the National Association of Convenience Stores (NACS) to develop the family dinner kits.

Square One convenience stores will test The Six O’Clock Scramble Fresh and Fast Family Dinner kits at its Bethlehem location. The kits contain healthy dinners for busy families. The September 30 launch at the Square One Markets store on 1125 W. Broad St. in Bethlehem, featured cooking demonstrations and recipe sampling from 12 noon to 6:30 p.m. with the creator of the dinner kits, renowned cookbook author, Today show contributor and The Six O’Clock Scramble CEO Aviva Goldfarb. McCorkle praised the groups in attendance for the extraordinary work that they are doing — calling them the “unsung heros.” In addition, he expressed concern about SNAP benefits, if the federal government would shut down before a budget is approved.

Country Fair’s Janine Calabrese Honored by Lawmakers for Special Olympics Achievements Janine Calabrese, a part-time facility caretaker for a Country Fair in Erie, Pennsylvania, and seven other Pennsylvania Special Olympians were honored by the House of Representatives before its session on September 21. Calabrese, 28, is a swimmer who competed in 100meter freestyle and backstroke, and the 200-meter backstroke at the Special Olympics World Games in Los Angeles this summer. She won two gold medals and a bronze medal during the games. In addition to her recognition by the House of Representatives, Country Fair recognized her achievements during its anniversary celebration last month.

FMS Solutions Presents Financial Survey Results at PFMA Webinar In September, Mark Ehleben from PFMA Associate Member FMS Solutions presented a webinar to members on the findings of the Independent Grocers Financial Survey, conducted with cooperation from the National Grocers Association. Included in the results of the survey: • Regional differences in financial performance are noticeable. The west and southeast regions have reported 2.3 percent and 1.5 percent rises in profitability, respectively. The Midwest and northeast both have reported negative profit losses of 0.3 percent, including 16 percent of sales losses in the Northeast. Much of this was attributed to the regional developments in the wholesale industry. • The issue with the greatest reported impact on the independent grocer is competition, both in 2014 and 2015/16. Staffing, hiring, and retention rose to the second greatest reported impact, up from third in 2014. The economy, listed as the second greatest reported impact, was not among the top five in 2015/16.

• When discussing competition, the steady rise in Walmart Supercenters, as well as the dramatic spike in smaller “neighborhood markets” were identified as trends. • Competitive strategies that have risen in SKU in recent years include organics (72 percent), local produce (60 percent), store-prepared meals (58 percent), and private brands (56 percent). • When benchmarking the best financial performers with the overall response, the best performers are much better at reducing operational shrink managing inventory, reinvesting in the business, keeping debt levels low, and focusing on cost control. USDA Grants Available to Help SNAP Participants with Healthy Choices Agriculture Secretary Tom Vilsack has announced the availability of up to $16.8 million in funding to help participants in the Supplemental Nutrition Assistance Program (SNAP) increase their purchases of fruits and vegetables. The funding is available to local, state and national organizations to test incentive strategies to help SNAP participants better afford healthy foods. This is the second round of awards to be made under the Food Insecurity Nutrition Incentive (FINI) program created by the 2014 Farm Bill. USDA’s National Institute of Food and Agriculture (NIFA) will administer the grants. FINI connects stakeholders from distinct parts of the food system and fosters partnerships to improve the nutrition and health status of lowerincome households. These resources will allow partnerships like these to help even more families. Funded projects will test community-based strategies that contribute to our understanding of how best to increase the purchase of fruits and vegetables by SNAP participants through incentives at the point of purchase, supported by efficient benefit redemption technologies, that inform future efforts. The Mid-Atlantic Food Trades Organization (MAFTO) honored the members of the Retail Marketing Group (RMG) during a reception at the Philadelphia Marriott last month, where they heard from Saint Joseph’s University head men’s basketball coach Phil Martelli. Coach Martelli, who is in his 21st year at SJU, spoke about his passion for Coaches vs. Cancer of Philadelphia, which consists of six Philadelphia men’s basketball coaches from the National Association of Basketball Coaches, who work to raise money for the American Cancer Society. In the past 20 years, the program has raised $12 million to eliminate cancer.

He relayed that he takes his players there to volunteer. “A true hero is someone who helps another person they will never meet,” Martelli said. MAFTO donated $5,000 to Coaches vs. Cancer and Marketing by TKE offered to matched the first $500 additional raised for the cause, for a grand total of $6,500.

PAMR Awards Ray Charley with Lifetime By Edward Conley

Ray Charley, recipient of the Pittsburgh Association of Manufacturers Representatives’ (PAMR) Lifetime Award of Humanitarian Achievement, comes by his generosity quite naturally. Charley, who operates three Charley Family SHOP ‘n SAVE supermarkets alongside the next generation of sons Mike and Tom, is quick to acknowledge he is “the beneficiary and recipient of the largesse of my father and uncles. Not many had that experience of their family. I am a lucky guy.” Following the footprints of grandfather Mike Charley and the Charley brothers Jim, Fred and Bill, Ray Charley began his lifetime of humanitarian achievement from his entrance into the supermarket business more than 30 years ago, formulating the best ways to give back to his community. A member of Rotary International, he has received that organization’s Paul Harris recognition. Ray Charley’s humanitarian outreach encompasses significant impact upon feeding people, health and welfare and children and youth. Food banks are a priority, most notably through Operation Santa Claus, which feeds more than 7,000 people at Christmastime in conjunction with SUPERVALU and Trib Total Media. Charley supports food banks, such as recently raising more than $800 for the Loaves and Fishes food pantry in Murrysville and annually support-

Improving wellness is another facet to Charley’s continuing focus on “the greatest importance” in the community. Charley has served as chairman of the Westmoreland Frick Hospital Foundation, which raises significant funds, including a recent $1 million initiative supporting the ICU at Westmoreland Hospital. The Charley SHOP ‘n SAVE in Murrysville donated $1,200 to the Blackburn Center for Domestic Abuse and supports the community’s Light Up Night and Murrysville Days. Charley also served the United Way of Westmoreland County as past president of the annual campaign and member of the board of directors. Of course, Charley is just as dedicated to his third priority, children and youth.

Award for Humanitarian Achievement

“That’s our future,” he reminds. “I’ve been involved in children and youth since I’ve been in business.” He is past board chairman of the 4H program, annually purchasing champion animals since 1984 from the Westmoreland County 4H and the Penn State Cooperative programs. The Boy Scouts of America has also benefitted greatly from Charley’s humanitarian endeavors. For about two decades, he has served on the board of the local council and Board of Trustees of the Endowment. Since the late 1990’s, following his father’s lead, he became chairman of the annual SHOP ‘n SAVE Boy Scout Golf Outing, an overall SHOP ‘n SAVE event at Laurel Valley Country Club. With support from vendors and others, $25,000$40,000 is raised each year. Additional efforts on behalf of children and youth include Charley’s support of fundraising campaigns for the Franklin Regional Area Athletic Association and the Franklin Regional High School Football Association. Charley also played a significant role in supporting the $180,000 Jennings Womack fitness center at Greensburg Salem High School, which falls into health and wellness initiatives, along with children and youth. Charley stresses that the entire company makes these projects effective.

• PFMA President & CEO David McCorkle and Alex Baloga, director of external relations, attended the Pennsylvania Chamber's 31st annual dinner at the Hershey Lodge in Hershey, Pennsylvania. Actor Kevin Spacey delivered the keynote speech to the sold-out crowd. • PFMA associate member FMS Solutions presented PFMA's first "Lunch 'n Learn" webinar on the results of its Independent Retailer Financial Survey. FMS conducted the survey with the National Grocers Association. • PFMA staff attended the Governor's Food Security Summit at the Farm Show on September 29. PFMA President and CEO David McCorkle participated in the private industry panel, which also included Dennis Curtin, Weis Markets, Inc.; John Rice, Rice Fruit; and John Chrisman, Mid-Atlantic Dairy Association. Attendees were charged with creating a new blueprint for collaboration in finding solutions to Pennsylvania's hunger and nutrition problems. • PFMA's Gary Lauer and Elizabeth Peroni joined MAFTO members in honoring Retail Marketing Group last month at their fall dinner meeting, which also raised money for Coaches vs. Cancer. Saint Joseph's University head men's basketball coach Phil Martelli was the guest speaker for the event. • PFMA staff attended the grand opening of a new Sheetz convenience store in Harrisburg, and Gary Lauer, director of membership development, attended the grand opening of a new Wawa in Philadelphia. • David McCorkle and Gary Lauer joined the Pittsburgh Association of Manufacturers Representatives to honor Ray Charley, Charley Family Shop 'n Save.
