The Controversial Climb

For the first time since his symbolic stand against the corrupt Arroyo regime, Senator Antonio F. Trillanes IV ascended the mountains of Baguio to set foot on his alma mater, the Philippine Military Academy, and attend the PMA Homecoming held last February 19-22, 2015. Senator Trillanes is a member of the host PMA Class 1995 (Marilag), and was accompanied by his classmate and Magdalo Representative Gary C. Alejano, as well as several Magdalo officers who hail from different classes of the same institution. In hindsight, their participation sends a clear message. It shows that the

stigma that came with the events that transpired at Oakwood and Manila Peninsula is but a thing of the past. Cavaliers from different classes are now recognizing the efforts of the Magdalo in upholding the interest of not only the Armed Forces, but also of the Filipino masses. And why wouldn’t they notice, when the Senator, with the support of the the organization, has been identified as one of the best performing senators of the present congress as published by various media entities. To date, he has filed over 1032 bills and resolutions, 42 of which have been enacted into law, and 8 of which are already approved on the third reading.

In addition, the Homecoming coincides with a very sensitive issue – the Mamasapano clash, wherein 44 SAF Troopers paid the ultimate price on a mission to neutralize Malaysian terrorist Zulkifli Bin Hir, alias Marwan. While the Cavaliers (alumni) have splitting perspectives on the matter of accountability, they are united in one thought – that justice must be served. The Senator’s attendance is an act of support for this noble cause. Lastly, with all intrigue, conspiracies, and biases aside, the Homecoming in essence is a way of paying homage to the institution that deeply instilled within them the culture of Honor that made them into men of noble character. It is this same Honor that gave the Senator and his colleagues the guts to stand on a moral high ground despite the seemingly impossible odds. This annual event also aims to celebrate solidarity among generations of soldiers, both in and out of the service. In a nut shell, their participation reaffirms that the interests of Magdalo coincide with the interests of the AFP and of the country. With the participation of the Magdalo’s Lakan and the other Magdalo officers in this year’s Homecoming, more ventures between Magdalo and the AFP particularly those that will benefit many Filipinos are to be expected.

K-12 Suspension “Kalidad ang Kailangan, Hindi sa Patagalan” Sa darating na School Year 2016-2017 o halos isang taon mula ngayon ay tuluyan nang ipatutupad ang K to 12 program na siyang magbabago sa kasalukuyang sistema ng edukasyon upang di-umano’y maitaas ang antas ng edukasyon sa bansa. Malaking bahagi ng programang ito ang pagdaragdag ng dalawang taon sa high school o tinatawag na senior

high school, kung saan mas sasanayin ang kakayanan ng mga estudyante base sa larangan na gustong tahakin ng mga ito. Ayon sa DepEd, dahil sa kakayanang ito, ang mga high school graduate na pumaloob sa K to 12 ay magkakaroon ng mas magandang oprtunidad upang magkaroon ng

mga trabaho kahit hindi matapos sa kolehiyo. Hindi maikakaila na maganda ang hangarin ng programang ito para sa sistema ng edukasyon sa bansa ngunit ayon sa mga kritiko ng programa sa pangunguna ni Senador Antonio “Sonny” F. Trillanes IV, mas nakalalamang ang mga problemang maaring idulot ng programa kaysa sa mga benepisyong makakuha umano dito. Walang matibay na basehan na ang pagdaragdag ng dalawang taon sa high school ay magdudulot ng pagangat ng kalidad ng edukasyon sa bansa. Sa halip, pinapalala lamang nito ang nakalulugmok na sitwasyon ng ating mga paaralan, gayundin ang mahirap na sitwasyon ng maraming magulang sa pagpapa-aral sa kanilang mga anak. Sa pag-iikot na ginawa ni Sen. Trillanes sa maraming paaralan sa bansa, nakita mismo nito ang paghihirap na dinaranas ng ating mga guro at mag-aaral. Ang ilan sa kanila ay nagka-klase sa ilalim ng puno dahil walang sapat na silidaralan sa mga ito; at ang iba naman

ay gumagamit ng tinatawag na “make-shift” classrooms. Nasaksihan din nito ang multi-level na pagtuturo kung saan iisa ang guro ng mga Grade 1 hanggang Grade 4 na mag-aaral habang sabay-sabay na nagka-klase; at ang pagkakaroon ng maraming shifts ng klase para lamang magkaroon ng pagkakataon lahat ng estudyante na makapagklase. Maliban sa paghihirap na sasapitin ng mga magulang at mga estudyante, malaking dagok din sa mga guro at empleyado ng kolehiyo ang pagpapatupad ng programa, kung saan aabot sa 75,000 sa mga continuation on page 8....

Mamasapano Incident Nito Nito lamang, ang ating mga hakbang ukol sa pagkakaroon ng pangmatagalang kapayapaan sa bansa, lalo na sa Mindanao, ay muli na namang sinubok dahil sa pagputok ng sinasabing Mamasapano clash na kumitil sa buhay ng 44 na magigiting na miyembro ng Philippine National Police Special Action Force sa gitna ng isang lehitimong operasyon upang tugisin ang dalawa sa mga most wanted na terorista sa buong mundo, si Zulkifli Abdhir (Marwan) at Basit Usman. Tunay nga namang nakagagalit at nakalulungkot ang pangyayaring ito, ngunit hindi tayo dapat magpadala sa emosyon sa ating paghahanap ng katotohanan. Base sa mga impormasyong ating nakalap sa imbestigasyong ginawa ng Senado at bilang dating isang sundalo, nais kong ibahagi ang aking pananaw sa isyung ito na sana ay makatulong sa pagbibigay linaw ukol sa isyung ito. Sino nga ba ang may pananagutan sa operasyong ito, ang Presidente na sinasabing alam ang nangyaring operasyon; ang dating PNP Chief na si General Alan Purisima na sinasabing nag-uutos kay SAF Director Getulio Napenas kahit ito ay suspendido na; ang Armed Forces of the Philippines na sinasabing hindi agad nagbigaysaklolo sa mga SAF troopers; o si Diretcor Napenas na siyang may pangkalahatang hawak sa plano ng nasabing operasyon? Ito ang tanong ng marami sa atin. Una sa lahat, nararapat lamang na malaman natin ang mga tunay na pangyayari sa operasyong ito, hindi upang makahanap tayo ng masisisi, kundi upang maiwasan ang ganitong pangyayari sa mga susunod na operasyon at upang mabigyan ng katarungan ang mga nasawi sa labang ito, hindi lamang sa panig ng SAF, pati na rin ang mga sibilyang nadamay dito. Pangalawa, ang operasyon laban kay Marwan ay isang lehitimong operasyon upang madakip ang mga nasabing terorista. Lumabas sa isang pagdinig na ginawa sa Senado na may alam ang Pangulong Aquino sa planong pagdakip kina Marwan at Usman. Bilang Pangulo at Commander in Chief ng bansa, ang operasyon ng mga militar at pulis ay maaaring makarating sa kanya. Siya ang magdidikta ng direksyon sa pagkamit ng kapayapaan sa bansa, ngunit ang mga tinatawag na operational at tactical matters o ang partikular na plano sa mga operasyong ginagawa ng militar at pulis ay hindi nito maaaring panghimasukan. Sa pagkakataong ito,

may alam ang Pangulo sa magiging operasyon ngunit ang detalye kung paano ito ipapatupad ay nakabatay sa planong inilatag ni SAF Director Napenas. Gayunpaman, kung sakaling nakarating kay Gen. Espina ang planong ito, masasabi ba nating mababago niya ang plano nito? Muli, tayo ay babalik sa katungkulan niya bilang may pangkalahatang plano ng operasyon. Si Gen. Espina ay maaaring makaalam ng operasyon ngunit hindi nito maaaring baguhin ang nasabing plano. Ganito ang nagiging sistema sa kahit anumang operasyon sa militar at pulis. Pangatlo, sa isyung hindi pagbibigay tulong ng militar sa mga SAF, lumabas sa mga nakaraang pagdinig na nagumpisa na ang operasyon nang nakarating sa AFP ang balita ukol dito, base na rin sa planong ginawa ni Gen. Napenas o kanyang tinatawag na “time on target.” Ngunit sa kabila nito, lumabas din sa imbestigasyon na agad na sumaklolo ang militar, sa pamumuno ni 6th Infantry Division under General Edmundo Pangilinan. Ang hindi nito agad na pagpapaputok ng kanyon ay naaayon sa tinatawag na doctrine of artillery dahil sa kakulangan ng impormasyon na kanilang hawak tulad ng tamang lokasyon ng mga SAF troopers at ng mga kalaban nito. Lumalabas na kung sila ay nagpasabog ng kanyon, malaki ang tyansa na tinamaan ang SAF troopers na kung nagkataon ay siyang mas malaking problemang kahaharapin natin. Sa nagaganap na usapang pangkapayapaan sa pagitan ng gobyerno at MILF, masasabi nating nagkaroon ng lamat dito dahil sa sinasabing naging papel ng mga miyembro ng MILF sa trahedyang ito. Upang tuluyang magtagumpay tayo sa usaping ito, kinakailangan natin ang buong pakikipagtulungan ng mga miiyembro nito. Sa ngayon, ang usaping pangkapayapaan, lalo na ang pagpapasa ng sinasabing Bangsamoro Basic Law, ay dapat masusing aralin at hindi dapat madaliin upang makasigurong walang matatapakan na mahahalagang sekto sa usaping ito. Sa paglabas ng resulta ng imbestigasyong ginagawa ng Board of Inquiry ng PNP ay tuluyan pang lilinaw ang mga pangyayari. After Mamasapano Incident, What Now? Sa nakaraang issue ng “Ang Magdalo”, sumulat po ako patungkol sa Bangsamoro Basic Law (BBL) na ito ay isang maaaring pagkakataon para bigyan kalutasan ang kaguluhan sa Mindanao. Ganun pa man ang pagpasa nito ay hindi garantiya na ang kapayapaan at kaunlaran ay makakamit dahil ang usaping pangkapayapaan ay isang mahabang proseso. Akin ding hinimok ang lahat na bigyang puwang ang pagtiwala sa isa’t isa at magtulungan dahil tayong lahat ay may responsibilidad na maisakatuparan ang minimithing kapayapaan. Subalit, ang nangyari sa Mamasapano, Maguindanao na kung saan apat na pu’t apat (44) na PNP SAF ang nasawi in the process of arresting and neutralizing an international terrorist Marwan, ay malaking dagok sa usaping pangkapayapaan sa kadahilanan na kasama sa pumatay sa mga PNP SAF ay mga miyembro ng Moro Islamic Liberation Front (MILF), ang ating tinaguriang “peace partners”. Before the Mamasapo incident happened, the BBL has been smooth sailing in the House of Representatives. Nagkaroon ng thirty-six (36) public hearings ang House Adhoc Committee on BBL, of which I am a member, simula September last year hanggang January ngayong taon. Ginawa ang mga public hearings sa Bangsamoro core areas upang mapakinggan ang sentiments at suhestiyon ng mga stakeholders. upang masimulan na ng debate sa plenary. It is expected that before the Congress goes on recess on the last week of March, the BBL would have been passed by the House of Representatives already. The Senate is expected to follow the same schedule so that the President could sign it into a law. Nais ko lang linawin na kung masunod man ang schedule na ito, ang BBL ay nalinis na ng kung ano mang provisions na hindi sang-ayon sa saligang batas ng bansa. Comparatively sa ibang panukalang batas, napakabilis ng takbo nitong BBL. Expresslane kumbaga dahil ito ay prioridad ni Pangulong Aquino. Ako po ay humiling na ang pagbabalangkas ng BBL ay bigyan ng kaparehong haba ng oras katulad ng public hearings nito sapagakat halos hindi pa naiintindihan ng karamihan kasama na diyan ang mga kongresista mismo. However, it seems that the House leadership is focused on the schedule and is determined to beat the deadline. Sa kabila ng aking agam-agam sa BBL dahil sa aking experience at nasaksihan sa mga public hearings, pilit kung inuunawa at tinatanggap ang BBL because I want it to work. Ganun pa man, hindi maikakaila na mukhang may malaking pagkukulang ang ating OPAPP (Office of the Presidential Adviser on Peace Process) sa ilalim ni Sec. Ging Deles at ang kanyang negotiating panel sa pamumuno ni Chairman Miriam Coronel-Ferrer. Dalawang importanteng habilin ng Pangulo sa OPAPP ay (1) negotiate within the framework of the Philippine Constitution, and (2) do not promise something that the government can not deliver. Sa ganitong pamantayan, makikita na hindi ito nasunod ng OPAPP dahil maliwanag sa BBL version na isinumite sa Kongreso na ito ay naglalaman ng maraming provisions na masasabi nating questionable kahit sa mata ng isang hindi abogado. Mandato ng Kongreso na baguhin at ayusin ang laman ng BBL na naaayon sa saligang batas ng bansa. Ibig sabihin hindi maiiwasan na ma “water down” o mababawasn at mapapalitan ang mga provisions ng BBL. This will have an effect then of not delivering on the promise of the government. Malaking bahagi sa paghubog ng kamalayan ng taong bayan lalong lalo na ang mga mambabatas ay ang Mamasapano incident. Bilang bahagi ng kaunting background sa insidenteng ito, ang PNP SAF ay naatasang hulihin ang isang international terrorist na si Marwan at ang kanyang local counterpart na si Basit Usman na napaloob sa isang planong tinawag na “OPLAN EXODUS.” On January 25, Marwan was successfully neutralized after a brief firefight with PNP SAF troopers. However, on the process of withdrawing from the area of operations, sila at ang kanila pang ibang kasamahan ay nakasagupa ang pwersa ng magkahalong MILF, BIFF

(Bangsamoro Islamic Freedom Fighter) at PAGS (private armed groups). Ang kinalabasan, 44 SAF troopers, ilang MILF, BIFF at sibilyan ang napatay. Kami ay nalungkot dahil sa halip na kondenahin ng gobyerno ang mga pumatay, sinisi pa ang PNP na kung bakit hindi nag “coordinate” sa MILF at AFP. Pinanawagan natin sa pangulo na i-demand sa MILF na ibalik ang mga baril at kagamitan ng mga nasawing PNP SAF at isuko ang kanilang mga tauhan na kasama sa pumaslang sa SAF 44 bilang pagpapakita ng kanilang sinseridad. Gaya ng sabi ko kanina, isang malaking dagok ang Mamasapano incident sa usaping pangkapayapaan sa MILF kasama na dito ang timely passage ng BBL. Ang dating tago na BBL ay napilitang lumantad sa kamalayan ng taong bayan. I consider this as a blessing dahil ang BBL ay kailangan ng pag-unawa at laganap na pagtanggap ng nakakaraming Pilipino. Ito rin ang pagkakataon upang alamin ang tunay na motivation, intention at sincerity ng MILF. Kailangan magkaroon ng malinaw na kasagutan at commitment ang MILF sa mga sumusunod; 1. Ano ang ginagawa ng terrorista sa lugar na kontroladp ng MILF? Kinakanlong ba nila ang mga ito in violation of the ceasefire agreement? 2. Ano ba ang tunay na relasyon ng MILF sa BIFF na tinuturing mga kriminal at dapat ding itaboy palabas ng kanilang mga kumonidad? 3. Kontrolado ba ng MILF Central Committee ang mga subordinate commanders nito? Umaga pa lang ng January 25, tinawagan na ang kumander ng MILF na napabakbak sa PNP SAF na tumigil sa putukan na hindi naman sinunod. 4. Ano ba ang mindset ng MILF fighters? Niyayakap ba nila ang salitang kapayapaan at naghuhunos dili sa agarang pagpatay ng tropa ng gobyerno sa kadahilanan na sila ay hindi nag coordinate? 5. Tapat ba sila sa usaping pangkapayapaan na sa panahon ng tigil putukan sila ay lalong nagpapalakas at nagpaparami ng pwersa na kabaligtaran sa envisioned decommissioning o pagbabawas ng kanilang pwersa? Ito ang mga katanungan na dapat maliwanag na masagot ng MILF dahil ito ay may direktang implikasyon sa kanilang pakay sa usaping pangkapayapaan. Ito ay labas sa usapin ng mga provisions ng BBL. Noong nakaraang February 23, kami ay pinatawag at kinausap ni Pangulong Aquino kasama ng mga liderato ng House of Representatives at mga political parties para pag-

usapan ang dalawang importanteng bagay; ang kanyang partisipasyon sa OPLAN EXODUS at ang kanyang pag apela sa pagpasa ng BBL. Sa aking bahagi, pinarating ko sa pangulo ang perception ng karamihan na siya ay isang mahinang leader sa kadahilanan na hindi siya tumatayo sa gitna ng kaguluhan lalong lalo na sa sigalot sa pagitan ng AFP at PNP. Ako ay nagalala na masira ang mga ahensiyang ito dahil sa kanila nakasalalay ang seguridad ng buong bansa. Ang pangalawang isyu na aking pinarating ay patungkol sa BBL. Hindi napapanahon ang pagsulong ng BBL sa gitna ng paghanap ng hustisya sa SAF 44 at sa gitna ng mataas na emosyon ng taong bayan. It would be ironic to push for the passage of BBL as it would appear that the government is rewarding the MILF because they are the primary beneficiary of this while on the other hand they are also the primary party who killed the SAF 44. Habang di pa maliwanag ang mga isyu na pumapalibot sa Mamasapano incident marapat lamang na isuspende ang pagdeliberate ng BBL. After all have been said, the president insisted for the passage of BBL and he won’t be deterred from pursuing it according to the timetable he has set. Malacañang actually challenged those who have other views of the BBL to offer alternatives. Sa totoo lang, maraming alternatives na pwede isulong. Isa na dito ang pagpatibay ng kasalukuyang ARMM (Autonomous Region of Muslim Mindanao) sa pagitan ng pag-amiyenda ng mga provisions nito na hindi gumagana o obsolete na. Dapat ding isaalangalang ang lahat ng stakeholders lalo na ang MNLF (Moro National Liberation Front), local governments, Lumads at iba pa. Bottom-line is, it should be inclusive as opposed to BBL that is purely MILF. Ang isang advantage ng pag-amend ng ARMM ay ang issue ng inclusion. People of the ARMM will only be asked on whether they agree with the amendments or not. Wala nang tanong kung sasali ba sila o hindi. The plebiscite that will be held once BBL is passed will not guarantee that the present ARMM areas will expand. On the contrary, there is a possibility that it will shrink in size. Ayon sa pangulo, what was offered to MILF was greater than what was already given to them (ARMM). Hindi ako naniniwala dito dahil ang batas na RA 9054 na bumuo ng ARMM ay hindi pa fully optimized. Dagdag pa dito nagkulang ang national government to account the officials of ARMM on how they spent the resources allocated to them. In my own personal assessment of the fate of BBL, definitely it will face a great challenge considering that almost all of the Congressmen I have talked to have lost trust to the GPH-MILF peace process itself. withdraw support to BBL. Ganun pa man, hindi dapat ibasura ang usaping pangkapayapaan dahil dito lamang magkakaroon ng bagong oportunidad sa kapayapaan at kasaganaan sa Mindanao. Sa aking mga assignments sa Mindanao lalong lalo na sa Bangsamoro areas, aking napagtanto na simple lamang ang hangarin ng isang ordinaryong muslim. Nais lamang niya magkaroon ng kapayapaan, pagkain sa hapag kainan, trabaho para mabuhay, gamot pag sila nagkakasakit, edukasyon sa kanilang mga anak, respeto sa kanilang karapatan at seguridad para sa kanilang pamilya na katulad din ng isang ordinaryong mamamayang Pilipino. Sa makatuwid, this can be well addressed in the present set up of one government, one flag and one constitution.

Sea. Its largest natural grouping has approximately 170 features and they compose the Spratly Islands archipelago, which covers a total of less than 3 nm2 of land above sea level nestled in an area spanning 58,000 nm2 of sea. The Spratly Islands are centered in the southern half of the South China Sea ap-proximately 300-nm east of Vietnam, 200-nm west of the Philippines, and 800-nm south of the Chinese mainland. The Economic Importance of the Spratly Region. Joining the Pacific and Indian Oceans, the warm South China Sea is among the most biologically diverse areas in the world, rich in both endangered species and commercial fish like tuna, mackerel, scads, and coral reef fish. The South China Sea is one of the earth’s most productive fishing zones in terms of its annual maritime catch representing about 10 percent of the world’s total take, and contributes about half of the fish eaten in the Philippines, Vietnam, and China especially in poorer coastal areas. Seafood was also Vietnam’s second largest foreign exchange earner in 2010 accounting for 7 percent of its exports, and composed over 4 percent of the Philippines’ gross domestic product (GDP) in 2009. The nature of the partially enclosed South China Sea and migratory nature of these fish stocks mean this important source of food and trade is a shared resource among the bordering states - thereby posing a “tragedy of the commons” dilemma in managing its stocks and genetic sustainability. Since the late-1990s, over-fishing, coral reef damage, and coastal and shipping pollution have threatened the sustainability of fishing in the South China Sea, with no substantial international coordination yet in in place to halt continuing dwindling of fish stocks. Instead, declining fish stocks in home waters have forced fishermen into waters claimed by other states, precipitating adverse reactions by maritime law enforcement officials in order to protect commercial interests within their claimed areas. Fishingrelated incidents thus are common in the South China Sea and sometimes lead to diplomatic or armed clashes.

The extraction of hydrocarbon energy resources in the South China Sea also suffers under the tension of being an asset of the maritime commons. The shallower southern South China Sea,

which includes the Spratly Islands, has been called a “second Persian Gulf” or an “El Dorado” for hydrocarbons for its rich potential. Certainly the possibility for energy strikes in the area’s sedimentary basins exists. However, the Spratly Islands region itself remains largely unexplored so estimates vary widely. The U.S. Energy Information Administration (USEIA) in 2013 gives proven or probable reserves in the Spratly region at virtually none for oil and only 0.1 trillion cubic feet (tcf ) for natural gas. However, USEIA estimated the potential for undiscovered oil from as low as 0.8 billion to as high as 5.4 billion barrels (bbl) and anywhere from 7 to 55 trillion cubic feet for gas. China’s CNOOC or Chinese National Offshore Oil Company offers a far more optimistic estimate of 125 bbl of oil and 500 tcf of gas in undiscovered resources, which is five times China’s current proven reserves in both resources. This may be skewed in order to encourage investment and exploration since China’s domestic production has peaked, and it depends heavily on imported energy. China needs the “sweeter” crude oil that comes from the South China Sea because it is easier for overburdened Chinese refineries to process, makes China more energy independent as its demand for oil doubles and natural gas quadruples in the next 25 years, and reduces the debilitating air pollution of burning coal which now accounts for much of its energy. The exploration for oil in the vicinity of the Spratly Islands started in the 1970s around Reed Bank by a Philippine consortium including U.S. companies, but the results were meager. China started drilling in 1992 near Vanguard Bank, using the American company, Crestone, while just to the west, the Viet-namese explored the Blue Dragon area with another American company Mobil, and to the southeast, Malaysia contracted with Sabah Shell. Further afield in the South China Sea, commercial drilling is ongoing in Malaysia’s Central Luconia gas fields off the coast of Sarawak; in Indonesia’s Natural Island gas field, and Vietnam’s Lan Tay and Lan Do gas fields. The Philippine’s Malampaya field, thankfully, lies northwest of Palawan and just outside the Spratlys area and may hold 2.7 tcf of natural gas reserves. It also holds the distinction of being the only producing gas field in the Spratly region. The belief that such finds may extend to the Spratly Islands’ waters, whose central placement makes maritime possession uncertain, encourages the affected parties to make competing, sometimes outsized, claims for this wealth. The richest part of the Spratlys may be the shallow Reed Bank, in the northeast corner and only 150-nm from Palawan, but it is also claimed by China, Taiwan, and Vietnam. there in 2002, the Philippines assigned concessions for its development; however, Chinese pressure has halted subsequent activities in Reed Bank. Such overlapping claims make financing and exploration to confirm potential energy reserves in the region more costly and risky, as demonstrated by Beijing’s threats to the businesses of foreign companies in China if they help develop the stakes of other claimants. Further complicating the problem is that more than 200 international companies are contracted for oil and natural gas services in the greater South China Sea region which internationalizes and complicates the dispute because China disapproves of foreign companies being involved in the region. International energy companies have the expertise needed to develop these waters but remain reluctant to do so, needing long-term stability in the region. The potential for major energy finds in the Spratly Islands area has driven energy-poor but rapidly developing surrounding states (like Vietnam and the Philippines) to press claims for this disputed commons which, in turn, hobbles their efforts by making exploration and exploitation economically more risky, politically contentious, and militarily dangerous. Unfortunately, the states claiming this area “view the competition for access to and ownership of the resources as a zero-sum game.” For instance, after the 2008 dissolution of the disappointing Joint Maritime Seismic Undertaking (JMSU), the first and only multilateral cooperative development arrangement among the South China Sea states, its former members, Vietnam, the Philippines, and the China, began to explore unilaterally in their overlapping claimed areas, and China increased the number of its enforcement vessels in the region. Claims have intensified as new technology has made previously difficult offshore oil and gas more accessible, while high energy prices make their potential more lucrative. Thus political and armed clashes may occur in order to develop this energy potential before others exploit it first. If the waters around the Spratlys have historically been fishing grounds and today portend hydrocarbon wealth, the land features themselves have offered much less in economic activities and have never been permanently inhabited beyond recent military garrisons. GAVEN REEF - What was just a patch of white sand last June 2014, through massive sand dredging, had become in just 3-months time a budding island-fortress. The latest photos of Gaven Reef show, as of the end of January this year, that it had become host to a 6-storey facility with more concrete structures in the works. FIERY CROSS [also known as KAGITINGAN] REEF. What was just a solitary structure for many years, had become drastically-transformed by July 2014. By September 2014 when we took another look, fullblown reclamation activities were already underway just 1.5 nautical miles from that solitary structure. By all indications, Kagitingan is being prepared to host at least an airstrip or even a runway. CHIGUA REEF - The surrounding area has bustled with construction activity. This was just last August 2014. Kindly verify photos of it last September, and October. According to the latest photo of the reef last January 2015, it looks like it is being reconfigured into an airstrip as well. And notice, too, that it has a 6-storey building undergoing construction. That day in January of this year, we also confirmed the ominous presence of a Chinese PLA Navy Yuting-II Type 7211 amphibious warfare ship, identifiable as “Danxiashian” because of its Bow Number, 934. Punta naman po tayo sa ZAMORA REEF, known internationally as SUBI REEF. Makikita na solitary structure pa lamang ito in 2009 - but is it now the subject of massive reclamation activities right now - based on the photos taken this January 2015. Again, based on another photo confirmation, we have observed the omi-nous presence of the Chinese PLA Navy Yuting III Class 72A Type ship. It was later identified as the Landing Ship “Luhuashan” through its Bow Number, 997, and is known to be capable of loading 10 battle tanks and 250 fully-equipped troops and comes with a helicopter platform. The most troubling of all are current efforts of China to reclaim the infamous MISCHIEF REEF, fondly

known to us as PANGANIBAN REEF which was seized from the Philippines and illegally-occupied by China in 1995 after the US left Clark Air Base and Subic Naval Base. Alam nyo po, walang sinabi ang Philippine reclamation efforts sa Roxas Boulevard at ang pagtatayo ng SM Mall of Asia kumpara sa ginagawa ng Tsina sa West Philippine Sea. Notice again the very visible presence of the Chinese PLA Navy, this time a Jianghu Class Type 053 ship or surface warfare frigate, identified as “Jinhua” with Bow Number 534. Hindi po nakakatawa itong mga nangyayari. Bagkus, nakakatakot ang hinaharap ng Pilipinas lalung-lalo na ang walo nating mga Marino na nakadestino at nagbabantay sa karatig na Ayungin Shoal o ang Second Thomas Shoal. Nagbanta po ang Tsina na kukubkubin nila ang Ayungin Shoal, at nito lamang nakaraang taon, paulitulit nilang hinarang ang mga supply ships natin na nagdadala ng pagkain at logistics sa ating tropa. Sa tantiya ko po, bago matapos ang taong ito, buo nang maisasakatuparan ng Tsina ang pag-blockade nila sa Ayungin Shoal, forcing us to permanently withdraw our Marines from BRP Sierra Madre at ito po ay tuluyan nang maaagaw sa Pilipinas. Let us remember that Ayungin is less than 50 kilometers away from the Chinese-controlled Mischief Reef, and the Chinese can easily cut off our Marine detachment in Ayungin from the rest of Palawan which is still roughly 400 kilometers away. History reminds us that China has never been shy about using all means at its command to further its aims. In this diagram from the esteemed publication Foreign Affairs, China has - for over sixty years to this date been involved in the most number of disputes in the South and East China Seas and most of them against the Philippines (24 incidents), Japan (19 incidents), and Vietnam (17 incidents). Even the United States has figured in 6 of these disputes with China. The bloodiest happened in 1988, a video of which I showed in this same chamber in August of last year, that saw 70 Vietnamese sailors mercilessly butchered by the Chinese PLA Navy. Ranged up against China, we are seriously outmatched and outgunned, even when we talk of comparative Coast Guard or maritime constabulary strength alone.

Mr. President, huwag mo sanang madaliin ang pagpapasa ng BBL, ikaw na ang nagsabi na ama ka ng lahat, minsan kailangan mo ding makinig at makiramdam. Let us all be reasonable and responsible… for our poor and humble people. If we really are for peace, let us work for peace. Let us think of and for every Filipino. Let us think us one Nation. Hindi po ito ‘ako’, hindi po ito ‘kami’, hindi po ito ‘rehiyon’ ko, hindi ‘grupo’ ko, hindi ‘relihiyon’ ko. Ito po ay para sa bawat mamamayang Pilipino.

The Mindanao Problem The agony of a human being is best expressed by a child. This was dramatized during the visit of Pope Francis III when Glyzelle Palomar, a former street kid, asked the pope why does God let children suffer. Another former street child, Jun Chura, told Pope Francis about his

struggle to survive without a home. This incident captured the hearts of millions not only in the country but also the world. Certainly, the pain of Manila’s street children is nothing compared to the agony of children in Mindanao during armed conflicts. The decades or centuries of intermittent wars and conflicts have displaced thousands of Mindanao residents and denied the young of the much needed opportunity for growth and development. When President Benigno Aquino C. Aquino III was elected in 2010, one of his most important quests was for the cessation of hostilities in Mindanao. He has inked an agreement with MILF, the biggest rebel group in the area. The peace pact evolved under the so called “Bangsamoro Basic Law” (BBL), which is now under heavy scrutiny and criticisms after an incident few days after Pope Francis left the country on January 19, 2015. On January 25, 2015 the Special Action Force (SAF) went to serve the Warrant of Arrest for international terrorist Zulkifli bin Hir, alias “Marwan,” and the Malaysian-born bomb expert’s Filipino deputy, Abdul Basit Usman in Mamapasano, Maguindanao. According to the PNP, Marwan died on that day, Usman escaped, but the country has to mourn for the death of forty four (44) SAF operatives who exchanged gunfire with the Moro Islamic Liberation Front (MILF) and the Bangsamoro Islamic Freedom Fighters (BIFF). Emotions are high and the importance of peace is now saddled with the call for justice of the fallen 44. Some are even shouting for an all-out war against the MILF. The conflicts in Mindanao that have displaced thousands for decades is looming to be back again if the BBL is stalled primarily due to the death of 44 SAF operatives. But is the BBL the final solution to the decades’ long conflicts in Mindanao in the first place? We dealt with the MNLF through the passing of Republic Act No. 6734, otherwise known as the Organic Act of the Autonomous Region in Muslim Mindanao (ARMM) by then President Corazon C. Aquino. Meanwhile, the Moro Islamic Liberation Front (MILF), another Moro armed group, continued with their struggle due to unsettled differences and ideologies. The Estrada administration tried allout war against the MILF. Despite winning the war, somewhere along the way, the lack of economic follow up and other erroneous decisions got in, thus it failed. In fact it bred more fighters and inspired others to rebel all the more. At present, while the present administration is trying Rajah’s Corner continuation on page 7....

to forge a peace pact with this MILF group through the Bangsamoro Basic Law, another Moro armed group, the Bangsamoro Islamic Freedom Fighters (BIFF) is gaining strength. So after we silence the MILF with the passage of BBL, we again have to deal with the BIFF. And the cycle goes on and on. As an ordinary Filipino citizen, my simple opinion to the resolution of the Mindanao Problem is ECONOMIC DEVELOPMENT. We did that to the New People’s Army. We brought the NPA to irrelevancy because of economic development. When people are happy and satisfied with their jobs and livelihood because of robust economic activity, the rebels were driven away because they cannot recruit and/or attract supporters. I believe that most combatants of the MNLF, MILF and BIFF, if given the opportunity, would choose to have a decent job or livelihood over a perilous life of being a combatant. So the government should focus on job creation in Mindanao. It should allot more funds in Mindanao and ensure proper utilization of such funds in order to spur economic activity in the area, thus creating jobs and livelihood for the residents. The military and police forces should focus more on safeguarding the implementation of government infrastructure projects as well as private investments. Corrupt local government officials should be prosecuted and jailed. Others may argue that the Mindanao problem is a very complex problem that needs a complex solution, but sometimes the best and most effective solution is the simplest one.

Add to that, we are in the bottom five in spending the least for defense out of 14 countries in East Asia and the Pacific. The Philippine government considers the Spratly group “vital to the defense of its western perimeter” and to its economic survival. A total of over 1,500 troops from various claimant countries are probably deployed to between 45 and 52 positions in the Spratlys. Since 1971, the Philippines used to occupy nine (now down to eight) of its approximately 53 claimed geographical structures with a handful of Marines (down from 1,000 in the 1990s based out of Palawan). In 1975, Vietnam occupied 13 positions, and today garrisons the most features at around 29, with about 600 troops. Vietnamese forces maintain a 600-meter runway on Spratly Island itself, the region’s fourth largest island. But China virtually lays claim o the entire South China Sea and Taiwan

with its absurd and unsupported nine-dash line. The Philippines completed a 1,300-meter runway in 1981 on Thitu Island, the region’s second largest island, which we know more popularly as Pag-asa Island. To this day, the runway has never been repaired and the Dept. of Foreign Affairs has recently resisted repeated efforts of the Department of National Defense to rehabilitate it for fear of a backlash, which by the way also hosts its eponymous municipality under Mayor Bitoo-non. China was late in joining the scramble in 1988, but has aggressively settled about seven reefs and rocks, which have since been upgraded. Some of these features are close to those already occupied by other forces in a possible attempt to neutralize any claim by other states to the surrounding seas, which I demonstrated was the actual scenario in Ayungin Shoal under Chinese threat from the Mischief Reef. A “no new garrisons” policy was supposed to be reinforced by the non-binding Declaration of the Conduct of Parties in the South China Sea (DOC) in which China and all 10 ASEAN states agree to the nonuse of force, peaceful settlements, and to refrain from further manning unoccupied features. Instead of honoring this Code of Conduct, China has wantonly and blatantly disregarded the DOC through the following: As I have proven, they have physically altered the natural state of their occupied reefs and shoals through reclamation and converting such into fortified island-garrisons; they have crowded out Filipino, Vietnamese, and other fishermen from the bounty of the South China Sea by dispatching an armada of fishing vessels, backed up by Coast Guard and Chinese maritime ships, and shadowed just beyond the horizon by the menacing Chinese PLA Navy.

The constant presence of Chinese PLA Navy ships, as proven here, presents a clear and present danger to countries like ours who only have our fishermen and a meagre Coast Guard conducting token patrols and may even become disruptive of maritime commerce given that half of the world’s cargo ships and onethird of the world’s oil shipped by sea pass through the South China Sea.

They have impeded countries like the Philippines and Vietnam from pursuing their energy security goals by way of harassment of the former in the conduct of its oil and gas exploration in the Reed Bank, and against the latter by deploying an oil rig off the coast of Vietnam near the Paracel Islands; And finally, once China’s reefs and shoals become fully operational forts or garrisons naval, coast guard and other maritime vessels will have virtually 24-hour, 7 days-a-week, and year-round presence in the area and the possibility of an Air Defense Identification Zone or ADIZ will be put up over most of this region with Russian-made and indigenous Chinese fighters from the PLA Air Force and the PLA Navy can virtually deny everybody unhampered flight in the skies above the South China Sea. Let us not be lulled into inaction by the pending verdict of the UN International Tribunal on the Law of the Sea over our claims in the West Philippine Sea. Some analysts fear that a major discovery of oil or natural gas may again spark another round of clashes in a region lacking the mechanisms for the peaceful resolution of such disputes - and with the United States providing merely mixed signals of either facilitating conflict resolution or an outright confrontation with China. The think tank International Crisis Group, in fact, believe that all of the trends are in the wrong direction, headed towards conflict, where the “prospects of resolution are diminishing.” Those assessments bode poorly for the region, more so for our country. The avowed policy of government as regards the West Philippine Sea is highlighted merely by DFA’s Tripartite Action Plan heavily re-liant on arbitration, diplomatic protest, and a collective ASEAN effort towards an enforceable Code of Conduct (COC). The Tripartite Action Plan is a NO-ACTION PLAN, unconsciously inviting disaster to befall our nation and unconscionably binding other agencies like the DND, AFP, the Coast Guard and others to futility. I urge the National Security Council - President Aquino SIR - please convene already and tackle this impending existential threat to our country’s territory, sovereignty and economic well-being. Mark my words, when the Chinese forts and garrisons become online later this year or early next year, tell me if I will be the BOY WHO CRIED WOLF! For I tell you, the wolves will come, and they will come. And they will be from China. Thank you, salamat po mga minamahal kong kapwa Pilipino.

BA L I TA N G Samahan Blood Donors Line-Up Sa On December 7, 2014 an estimated one hundred fifty (150) blood donors came to donate blood at the Samahang Magdalo Bloodletting activity held at Barangay Roxas in Quezon City. This undertaking was spreaheaded by Filmore G. Rull, Vice-President for National Capital Region (NCR) with Rajah Norberto E. Santiago Jr., National President of Samahang Magdalo Inc.

This event was made possible through the efforts of, Nelson Olamit, Quezon City Coordinator, Vic Rivera; Chapter President of SM Taguig Chapter, Leticia Turing; Chapter President of SM Sauyo Chapter , and Dugong Magdalo (DM) Members . Samahang Magdalo, Inc has been periodically doing bloodletting activities in various chapters of the country. This is done to emphasize that blood donation is a healthy undertaking because blood taken out of the body is replaced by new healthy corpuscles. Blood is also necessary in times of emergency where transfusion is necessary. By donating blood, the donor actually saves lives.

Ayon sa coordinator ng activity na si Francisca Villanueva, pinili nila ang pagbigay ng pagkain dahil ito ang nakita nilang pangunahing pangangailangan ng mga biktima. Limitado ang maaring gawin ng mga nasunugan dahil sa pagkasunog ng mga ari-arian nila. Sabi ni Francisca, “Makapagbagbag damdamin” ang nakita nila sa pagpunta sa dalawang barangay.
