TO (Indirect Index): MARION COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA

412 SE 25th Ave. Ocala, FL 34471 WHEREAS CLAY ELECTRIC COOPERATIVE, INC. (“CLAY ELECTRIC”) is the owner of certain easement rights and interests as granted by Lawrence J. Leitner and Mrs. L. J. Leitner (“LEITNER”) on November 2, 1948 over, under, upon and across lands being a part of Section 16, Township 12 South, Range 20 East and being more particularly described in Deed Book 278 at Page 347 of the Public Records of Marion County, Florida; and WHEREAS MARION COUNTY subsequently purchased a portion of said lands from LEITNER on November 10, 1967, per the Warranty Deed recorded in Official Records Book 332, Page 32 of the Public Records of Marion County, Florida; and WHEREAS MARION COUNTY has granted a new easement in association with the construction and rebuilding of CLAY ELECTRIC’s existing facilities lying parallel with and adjacent to the Westerly right of way line of County Road 329, NOW, THEREFORE, for and in consideration of said new easement, dated ______________, 2016 and recorded in Official Records Book _____, Pages _____ and _____ of the public records of Marion County, Florida and other good and valuable consideration, the receipt of which is hereby acknowledged by both parties, CLAY ELECTRIC does hereby release, discharge and quit-claim to MARION COUNTY the easement rights and interests granted by LEITNER over, under, upon and across the real property described in said Warranty Deed recorded in Official Records Book 332, Page 32 of the Public Records of Marion County, Florida. Except for the property specifically released by this instrument, CLAY ELECTRIC expressly reserves and retains all of its remaining easement rights and interests.
