Dear Ms. Eastley, On behalf of TCI Lane Ranch, LLG I am requesting a two-vear extension of the current Preliminary Plan approvals for the TCI Lane Ranch PUD. The current approvals require that a technically complete Final Plat application be submitted by September 8,2OL6.This request is to extend that deadline to September 8, 2018. This request for an Extension of Conditionat Approval is made in accordance with
Seetion 4-101. of the 2013 Garfield County Land Use and Development Code, as follows:
l. Extension of Conditional Approval. It is the Applicant's responsibility to timely satisff any conditions of approval. Prior to the expiration of a conditionat approval, however, the Applicant may request an extension of the expiration date as follows: 1. Supporting Documentation. Application shall be made to the decision maker that issued the original approval and shall include a written explanation of the reasons why the conditions have not been met and the estimated timeframe id
which the conditions will be met or completed. 2. First Extension. a. Extensions of 1 year may be granted for allconditional Land Use Change approvals, and Subdivision or Conservation Subdivision Preliminary Plan approvals. b. 4. New Application Required. lf an Applicant fails to timely request an extension as set forth in section 4-101.1., the approval will be void and the Applicant must submit a new application for the desired Land Use Change or division of land approval notwithstanding the foregoing, the BOCC may grant an extension of an otherwise expired approval upon a finding by the BOCC that the failure to file for an extension was due to extenuating circumstances and that it benefits the public interest to grant the extension.

As noted in Tabte 1, prior one and two-year extensions were requested and approved. With the one-
year extension granted in 2010, the Board of County Commissioners expressly allowed for the applicant to request additional extensions in the future. The following is an excerpt from Resolution 2010-57 to
that effect: E. A motion was made to approve the extension of the Preliminary Plan to allow for the fiting of a technicatly comptete final plat unti! September 8, 201 1, with the ability for the
appllcant to request additionat extensions in the future. The motion was approved by a vote of 3-0.
Basis of Request This request for a two-year extension is being made pursuant to: The 2013 Garfield Countv Land Use and Development Code which allows for requests for longer periods of time, or additional time extensions following the first extension; a a
Resolution 2010-57. which allows for the applicant to make additional requests for extensions; And Resolution 2015-49, which extended the Preliminary Plan approval to September 8, 2015.
Narrative This section demonstrates the need for a two-year extension per Section 4-101.! of the 2013 Garfield
County Land Use and Development Code. Regional & Local Real Estate Market lnfluences TCI Lane Ranch was conceived and designed in 2OO7, prior to the U.S. economy experiencing its most severe recession since the 1930's. The community was designed with a significant amount of Open Space (59%) and high level of amenities that was generally fitting with the sales values of local real estate in the mid-Roaring Fork Valley at that time. The project also requires a lengthy extension of the Mid Valley Metro District's water and sewer lines. The result of these elevated design standards and significant infrastructure requirements is a community that is higher in cost-per-lot than most other subdivisions in Garfield County. The continued sluggish market recovery of vacant lots and high construction costs has thus far led to the inability to successfully bring the project to market since
Preliminary Plan was approved in 2009.

Marketing Efforts 2015-2016 Since early 2015, the developer has embarked on a concentrated effort to market TCI Lane Ranch
to
local and regional buyers. The end goal of this effort was to obtain approximately 15-20 soft reservation contracts (fully refundable) for lots. This marketing effort included:

HirinB a local real estate broker to lead sales efforts. Field surveying and staking of 25 (of 89) lots.
New website and marketing media/ video (www.tcilaneranch.com). Print and radio advertising campaign. Design and installation of site real estate signage.
Building temporary viewing platforms on several available lots. Listing 25 (of 89) lots on the local Multiple Listing Service.
This marketing effort has thus far proven that the current market for vacant lots is not yet strong
enough for the implementation TCI Lane Ranch as designed.
Current Efforts The development team has been consistently working to identify opportunities to bring TCI Lane Ranch
to fruition. On May t2,2OL6 our team met with County Staff to discuss the possibility of amending the PUD and Preliminary Plan to create additional density within the project. The goal of this density increase would be to create more mid-market homes in response to current market demand and the need for more locals-oriented housing opportunities. This opportunity has been thoroughly evaluated by the development team, and while we believe the market is strong for mid-market homes, the cost basis for such a development still carries significant risk to the developer.
More recently in August of 2Ot6, the development team has begun discussions with potential project partners regarding re-designing and marketing TCI Lane Ranch as an equestrian community. Market indications suggest that there is a high demand for such properties in the Roaring Fork Valley, with a dearth ofsupply. The success ofthe recent equestrian based re-development at Aspen Equestrian Estates is a positive indicator for such a design concept, while maintaining the rural characteristics inherit in the vicinity of the property. Our team is currently pursuing this equestrian-based concept, including the production of conceptual
site designs, programming, and fiscal analysis. Such concept will likely involve a slight decrease in density with the addition of equestrian-focused riding amenities and structures. Our current intent is to follow this track and submit a PUD and Preliminary Plan Amendment application to the County within the next several months.

Summary The state of the real estate development market and construction costs has required the developers
to
take a long-term view of this project, with a firm commitment to its design characteristics as an ecofriendly, lifestyle-based, and livable community that will serve as a positive example for other rural cluster communities in Garfield County and the region. We are requesting an additional two-year extension to re-tool our plan, and to submit an application for a PUD and Preliminary Plan Amendment to be brought before the County for review. A second request for extension was received from TCI Lane Ranch, LLC which the Board considered in a Public Meeting held on July 1 1, 2011. At that time the Board extended the Preliminary Plan for two (2) years, until September 8, 2013. The minutes to that meeting are attached as Exhibit G.

TCI Lane Ranch seeks a fifth extension, for a period of two (2) years which, if granted would extend the Preliminary plan until September 8, 2018.
